[Röszke11] 2. Prozesstag gegen Ahmed H. – Fortsetzung im Januar

Wir dokumentieren einen kurzen Bericht der Solidaritätsgruppe Röszke11 zum Prozesstag gegen Ahmed H. am 2. November 2017:

“Ahmed H had yet another trial today where he was accused of terrorism. The best note about it came from Ahmed H himself: “I cannot recognise myself, I lost my identity. Am I a man of Georg Soros (as Fidesz accused on Monday), a terrorist or a journalist?!” His humor gives a painfully accurate message about the nature of the overly politicized show trials he is going through. This man will remain jailed for at least three more months without being pleased guilty of anything.
We demand justice for Ahmed H and support the ongoing battle of Roszke 11!”

[Röszke11] Revisions-Prozess gegen Ahmed H. gestartet – Solidarität!

Am 30.11.2017 ist der Gerichts-Prozess gegen Ahmed H. in die zweite Runde gegangen. Er wurde vor einem Jahr in einem skandalösen Prozess für den Protest in Röszke 2015 zu 10 Jahren Haft verurteilt. Heute am 2.11.2017 ist der nächste Verhandlungstag. Wir dokumentieren einen Text der Solidaritäts-Gruppe Free the Röszke 11. Informiert euch, zeigt eure Solidarität!

Ahmed H. is one of the many people who protested on the border of Hungary at the Röszke/Horgos crossing to open the borders again on 15th September 2015. A few hours before Hungary had closed them and had made any crossing a criminal offense.  Afterwards Ahmed H. was captured by Hungarian authorities and they claimed he was a terrorist leader of the protests. On the 30th of November 2016, after over one year of isolation in prison, he was sentenced to 10 years of imprisonment for committing an “act of terrorism” and is since then in high security prison in Budapest. All requests for visit were rejected or simply ignored by the authorities. He is being isolated additionally since he cannot receive letters, except from his wife.On the 15th of June 2017 in Szeged, Hungary, Ahmed H. had his second instance trial which referred the case back to the first instance court to reconsider the terrorism charges due to “lack of reasoning and interpretation”. This reconsideration will take place on the 30th of October and continue on the 2nd of November. The trial against Ahmed H. is a racist showcase that tries to strengthen the idea that all migrants are terrorists and to criminalize another protest against the EUropean border regime (read more about the previous trials on our blog: http://freetheroszke11.weebly.com/).How can you support?

Ahmed H’s case will be retried, but he remains in prison. Ahmed is one of the Röszke 11 and is in prison for 2 years now.

Yesterday afternoon, the appeal court of Ahmad H. was held in Szeged (Hungary) .

The prosecutor started the session by refusing even the necessity of having an appeal court, since in his opinion the right to a fair trial was respected in the first instance court. He added that there is no need of hearing new evidence or witnesses and asked to exclude some of the police reports to be considered. He wanted to classify Ahmed not as a person holding a permit to free movement, but as a third country national. He finally concluded that the second instance court should uphold the decision of the first instance court.

The prosecutor’s argument against Ahmed is mainly that he should have known that the border was closed and that Hungary was only accessible through the transit zone. Ahmed later responded to this charge that he and his family did not know anything about the border being closed. At one point, Ahmed interrupted by asking to loosen the chains on his legs, because they were too tight. The judge used the situation to have a break.

After the break, the hearing of Ahmed continued, with a twist however, as the prosecutor repeated the first instance prosecution and demanded an even higher punishment – to increase his prison sentence from 10 to 17 and a half years.

Ahmed’s lawyer Bárándy criticized the treatment of the evidence in the first court and the first verdict as contradictory and insufficient. No evidence had proved that Ahmed was leading the crowd and some crucial exonerating materials were ignored in the first trial (e.g. one of the police’s recorded audio material was misused by the first court since the content of the transcript did not match the voice recordings).

Another point that was used against Ahmed was the fact that he was showing a V sign, which in the first court was misinterpreted. It was claimed that Ahmed was giving a two-hour ultimatum to policemen to open up the border. The defence mentioned this gross misinterpretation as a sign that the verdict of the first instance court should be rejected. He then continued by arguing that a verdict of such importance cannot include 205 technical words, since those words create a biased atmosphere. He finished his defence proclaiming Ahmed as NOT guilty for illegal entry since he was free to move within the EU and had the right to enter legally. He did not commit a crime but rather an administrative offence by entering Hungary.

The court finally concluded that although the first instance court had the right to refuse available evidence, it did not analyse it enough and did not sufficiently explain why such evidence was refused. Relevant facts were established, evidence was presented, but the decision lacked proper reasoning and deliberation. Thus, the verdict was not consistent and objective. Moreover, the first instance court should have analysed whether throwing stones was indeed an attempt to force a state organ, or just an act of losing self control – the latter would have meant that the terrorism charge was not valid. Additionally, there seemed to be confusion in the police report on how much time was given as an “ultimatum” and who gave it in the first place.

Since the first instance court based its decision on these confused and inconsistent testimonies and interpretations of facts, the second instance court was unable to make an informed decision. The court thus concluded that the case must be retried to examine the evidence properly and that this needs to be done by a new council. Until then Ahmed has to remain in pretrial detention.

Migszol Csoport strongly disagrees with the attempt to portrait Ahmed as a terrorist and denounces the instrumentalisation of his case by government affiliated media to trump up hate. The gross misuse of anti-terrorism legislation for thinly documented, minor offences makes the years-long imprisonment of Ahmed a scandal and a form of cruelty that caricatures any notion of the rule of law.

Not guilty! We demand Freedom for Ahmed!

The date for the trial against Ahmed at the second instance court is set for Thursday, 15th of June. In November 2016 Ahmed H. was sentenced to 10 years of prison for “terrorism” and “illegal border crossing” in the court of Szeged after a series of extremely biased trial hearings.

Ahmed’s trial and the show-trials against the other Röszke 11, the police violence and the harsh policy changes are supposed to state an example and create an atmosphere of fear. They are part of the Hungarian state’s increasing racist propaganda against all migrants, especially Muslims and part of the European repressive migration policies.
But freedom of movement is not a crime!
We demand Freedom for Ahmed!

Hungary: Release Ahmed H and stop abusing terrorism laws

Ahmed has been labelled a terrorist and jailed for 10 years after using a megaphone to call for calm during clashes at the Hungarian border.

In August 2015, Ahmed left his family home in Cyprus to go and help his elderly parents and six other family members flee Syria and find safety in Europe. One month later, they found themselves among hundreds of refugees stranded at the Hungarian border after police fenced off the crossing with Serbia.

Clashes broke out as some refugees attempted to get through. Hungary’s police responded with tear gas and water cannon, injuring dozens. Some people threw stones, including Ahmed. But news footage also clearly shows Ahmed using a megaphone to call on both sides to remain calm.

For this, a Hungarian court found him guilty of an “act of terror”, under Hungary’s extremely vague counter-terrorism laws, and sentenced him to 10 years in prison.

Does this sound like terrorism to you?

Ahmed remains in prison, separated from his wife and young daughters, waiting for an appeal hearing in the hope of being able to return to them in Cyprus.

Tell the Hungarian authorities to:

  •  Release Ahmed H and stop abusing terrorism laws.
  • Stop making statements linking migration and terrorism, which could prejudice the prosecution of Ahmed.
  • Coordinate efforts to ensure Ahmed’s swift return to Cyprus as soon
    as his appeal hearing is finished.

Nachdem Ahmed H. im September 2015 an der Serbisch-Ungarischen Grenze an Protesten teilgenommen hatte, wurde er willkürlich aus der Menge heraus festgenommen. Gegen ihn und die anderen festgenommenen 10 Personen der #Röszke11 begannen Show-Prozesse zur Machtdemonstration und Abschreckung der Festung Europa. Ahmed H. , dessen einziges Ziel es ist, für sich und seine Familie Sicherheit zu finden, wurde heute zu 10 Jahren Haft wegen “Terrorismus” verurteilt.

Gleichzeitig fanden Solidaritätsaktionen in Szeged (Ungarn) vor dem Gerichtsgebäude statt, in Kiel eine Kletteraktion und am 4.12. eine Demonstration in Budapest mit über 250 Teilnehmenden.

The court hearing of Ahmad H., arrested during the the protest at Röszke border 2015 and accused of “terrorism”, took place on 28 th of October in Szeged (Hungary). He is facing lifelong prison. On 28.10.2016 at 9.00 am the court hearing of Ahmad started. The police refused lots of solidarish people that protested in front of the court building to enter. Representatives of Amnesty International were refused to enter as well first and only after long discussion they were allowed to visit the trial. There was massive police presence, and Ahmad was guarded by two masked soldiers.

9.00 am. The trial starts. The document presented by the court states that was the leader of the protest. Among the proofs: migrants gave him pillows and food…The document has detailed description about what injuries the policemen had to suffer. Evidently they are the victims, not Ahmad or other refugees…

Then first time during the trial stood up to oppose. He was accused to talk in the phone. He says he didn’t. Judge said just “okay, fine”… claims phone recordings are fake, he did not instruct anyone how to cross the HUN border. The seized phones belong to his relatives.

denies the accusations and saying he is a peaceful follower of and he respects women. He says he went abroad to study Quran. He responds to alleged suspicious trips to Saudi & India. He went to former for hajj and latter to visit Muslim friends. Lawyer: “it’s fact that that every Muslims pilgrimage to Mecca. Catholics who go to Vatican are fanatics then?” Obviously the trial plays with the lack of knowledge about Islam.In the Hungarian judicial system Ahmad’s crime that he’s a Muslim

So far the “evidences” are presented. His newly appointed defence lawyer pleads for an adjournment in order to contact international journos and volunteers and to visit his client in prison to take instructions. Prosecutor opposes the request. Judge rises to consider.

Defence asks the court to hear other 25 witnesses and have a meeting with at prison.The lawyer asks to postpone the trial, that prosecutor attacks claiming that its just to win time. The decision will be made at 11 o`clock. Lawyer wants to attach recording as evidence that he recorded with during the incident. Prosecution not agrees because he claims the lawyer would have enough time to meet the defendant.

The claim to listen the new witnesses is refused, except for to listen witness György Rőczei, a policeman. Around 25 activists and journalists were among the witnesses, refused without any explanation..

The trial is postponed. The next trial will take place on th 30th of November at 9:00. A month to raise media attention and support for Ahmed H – The whole should take a look at this incredible racist showtrial in !

In Solidaritaet mit den Roeszke 11 und insbesondere Ahmad, dessen Verfahren vorgestern [28.10] zu einem Urteil fuehren sollte, haben wir in Berlin vor der ungarischen Botschaft in Berlin (nahe Brandenburger Tor) mit etwa 40 Menschen demonstriert.

Wir moechten auf die Kriminalisierung und die Ungleichstellung von gefluechteten Menschen Aufmerksam machen. Eine Ungleichstellung, die in Faellen wie dem der Roeszke 11 zur vollkommenen Rechtlosigkeit einer, von unserer rassistischen Gesammtbevoelkerung fallen gelassenen Minderheit fuehrt. Ein weiterer Fall gewollten Versagens der Justiz.Das Gerichtsverfahren basiert auf den diffusen Zeugenaussagen ungarischer PolizistInnen, einem tonlosen Video, das Ahmad beim Werfen mehrerer Steine zeigen soll und der “Fuehrungsrolle”, die er durch das Halten eines Megaphons eingenommen habe. Auf dieser Basis wurde der Vorwurf “Terrorismus” konstruiert und ganz nebenbei erneut ein rassistisches Feindbild “bestaetigt”. Hinzu kommen angebliche Verbindungen zu islamistischen Organisationen, welche ueber seinen Besuch der Laender Saudi Arabien und Indien begruendet werden. Freitag [28.10] wird er dann einmal mehr von vermummten Anti-Terror-Einheiten mit Hand- und Fußfesseln auf die Anklagebank gefuehrt. Fuer den eigentlich oeffentlichen Prozess werden praktisch keine PressevertreterInnen eingelassen, von AktivistInnen ganz zu schweigen.

Faelle wie diese Haeufen sich. Dabei wird der Schwebezustand von schutzsuchenden Menschen strukturell ausgenutzt um Kampflienen, zu Gunsten totalitaerer Staatsgebilde, zu verschieben. Lasst es nicht ungesehen geschehen. Verbreitet den Fall der Roeszke 11 und gebt ihnen eine Stimme, damit am 30.11. mehr Aufmerksamkeit fuer die voraussichtliche Verurteilung Ahmads besteht!

Ahmed H, one of the Röszke 11, accused for “terrorism and other crimes” is kept in custody and total isolation since one year. As Ahmed’s last court session was on the 23nd of September, solidarity demonstration took place in Budapest, Szeged and in Vienna, in front of the Hungarian embassy.

During the whole court hearing the judge was only reading the testemonies of the police who were allegedly injured during the so called riot. Ahmed’s lawyer was even not present, only his deputy. The police blocked the court corridor so the majority of the people who wanted to monitor the trial was not allowed to enter the courtroom. All forms of communication with Ahmed were prevented.

Still, the people who gathered to demand the freedom of the accused managed to send their messages of solidarity via playing and singing songs of resistance, and showing signs behind the police blockade.

The police was constantly making pressure and threatening with starting misdeme anor procedures against the protesters. When the trial was finished people in solidairty were waiting for Ahmed to be carried out from the courtroom, but instead of it, he was locked into another room. As a sign of disobedience some people refused to leave the court building until they were evected by the police. The last person who left the building was a 73 years old lady who came to Szeged in order to protest.

The next court session will be on the 30th of November, when the first level sentence is expected to be read out. Let’s organize and show the power of solidarity! Support the solidarity campaign where ever you are!

We should not forget about Yamen A., Farouk A., and Kamel J., the other 3 people from the Röszke 11, who got already sentenced and who are imprisoned in differnt prisons over Hungary.

Defence asks the court to hear other 25 witnesses and have a meeting with at prison.The lawyer asks to postpone the trial, that prosecutor attacks claiming that its just to win time. The decision will be made at 11 o`clock. Lawyer wants to attach recording as evidence that he recorded with during the incident. Prosecution not agrees because he claims the lawyer would have enough time to meet the defendant.

The claim to listen the new witnesses is refused, except for to listen witness György Rőczei, a policeman. Around 25 activists and journalists were among the witnesses, refused without any explanation..

The trial is postponed. The next trial will take place on th 30th of November at 9:00. A month to raise media attention and support for Ahmed H – The whole should take a look at this incredible racist showtrial in !

Ahmed H, one of the Röszke 11, accused for “terrorism and other crimes” is kept in custody and total isolation since one year. As Ahmed’s last court session was on the 23nd of September, solidarity demonstration took place in Budapest, Szeged and in Vienna, in front of the Hungarian embassy.

During the whole court hearing the judge was only reading the testemonies of the police who were allegedly injured during the so called riot. Ahmed’s lawyer was even not present, only his deputy. The police blocked the court corridor so the majority of the people who wanted to monitor the trial was not allowed to enter the courtroom. All forms of communication with Ahmed were prevented.

Still, the people who gathered to demand the freedom of the accused managed to send their messages of solidarity via playing and singing songs of resistance, and showing signs behind the police blockade.

The police was constantly making pressure and threatening with starting misdeme anor procedures against the protesters. When the trial was finished people in solidairty were waiting for Ahmed to be carried out from the courtroom, but instead of it, he was locked into another room. As a sign of disobedience some people refused to leave the court building until they were evected by the police. The last person who left the building was a 73 years old lady who came to Szeged in order to protest.

The next court session will be on the 30th of November, when the first level sentence is expected to be read out. Let’s organize and show the power of solidarity! Support the solidarity campaign where ever you are!

We should not forget about Yamen A., Farouk A., and Kamel J., the other 3 people from the Röszke 11, who got already sentenced and who are imprisoned in differnt prisons over Hungary.
